Terms of Use

1. Acceptance

By using the CigarMind mobile app, account and sync services, or this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the relevant service. CigarMind is operated by Shanghai Souldigger Information Service Co., Ltd. (“we”).

App stores, device operating systems, and third-party services may impose additional terms. Mandatory consumer protections and platform rules prevail where applicable.

2. Adult eligibility

CigarMind is only for adults who have reached the legal tobacco-use age where they live and can enter into these Terms. You may not create an account for a minor, submit data on a minor's behalf, or enable a minor to use the product. Do not use tobacco-related features where local law prohibits possession, use, or recordkeeping.

3. Purpose and boundaries

CigarMind provides collection records, inventory events, humidor readings, tasting journals, data export, optional weather, optional AI image candidates, and an advisor that ranks only in-stock items you provide. Core collection features work without an account.

4. App license

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use CigarMind on compatible devices you own or control. You may not unlawfully copy, rent, resell, bypass security, attack, scrape, or interfere with the service.

If downloaded from the Apple App Store, Apple's Standard Licensed Application End User License Agreement also applies unless the App Store product page expressly provides a custom license.

5. Your content

You retain rights you have in lawfully entered photos, collection facts, humidor data, and notes. You are responsible for having the right to use and submit them. You grant us a limited license to process that content only as necessary to provide recognition, advisor, sync, export, security, and support functions you request.

Do not submit unlawful material, another person's sensitive data, infringing content, or unrelated private photos. You control exported files and should review them before sharing.

6. AI features and confirmation

AI image recognition sends a request through the CigarMind API to HY-Vision via Tencent Cloud TokenHub and returns up to three candidates. Candidates do not automatically enter your collection: only a candidate you expressly confirm is saved. The in-stock advisor uses DeepSeek to rank items you supply.

Generative models can omit, confuse, or fabricate brands, formats, origins, years, box codes, flavors, and reasoning. Confidence and scores are not identification probabilities, authenticity certificates, valuations, health conclusions, or guarantees. Independently verify any output before saving, acting on, or sharing it.

CigarMind does not give medical, legal, investment, insurance, tax, or professional authentication advice. Consult a qualified professional for health, law, authenticity, value, or financial decisions.

7. Sign in, accounts, and sync

Sign in with Apple and cloud sync are optional. Protect your device, Apple account, and CigarMind session; never share an authorization code or session token. You are responsible for activity under your account and should sign out and contact support if you detect misuse.

Cloud sync transfers structured collection, tasting-journal, and humidor records between authorized devices. Network loss, concurrent edits, or defects can cause delays or conflicts, so export important records periodically. Signing out, clearing local facts, and deleting the cloud account have different effects; see Account Deletion.

8. CigarMind Premium auto-renewal

CigarMind may offer a monthly auto-renewing CigarMind Premium subscription through the Apple App Store. Basic local collection remains available for free; Premium currently includes AI recognition, full Cigar DNA, contextual AI recommendations, and cloud sync. CigarMind does not impose an undisclosed business-use count, though security, anti-abuse, and system-capacity limits still apply. The product name, localized price, tax, billing period, any trial, and current benefits are those shown in the app and Apple's purchase confirmation.

Apple charges your Apple account after confirmation. Unless you cancel through Apple's subscription management before the current billing period ends, the subscription renews under the terms Apple displays; verified benefits normally continue through the paid period after cancellation. Refunds, billing grace, revocation, and Family Sharing follow applicable law, Apple's rules, and the product configuration. A downgrade does not delete existing local collection data; the collection remains readable, maintainable, and exportable, while AI and multi-device features pause. Deleting the app, signing out, or deleting a CigarMind account does not itself cancel the Apple subscription; manage it separately with Apple.

9. Third-party services

Optional features may depend on Apple, Open-Meteo, Tencent Cloud TokenHub, HY-Vision, DeepSeek, and hosting infrastructure. Third parties can change, interrupt, or stop their services and process requests under their own terms. We take reasonable steps when selecting and securing integrations but do not control their continued availability.

10. Responsible use and compliance

Tobacco and nicotine are addictive and harmful to health. CigarMind does not encourage anyone to start, increase, or continue tobacco use. Follow local age, possession, use, transport, gifting, advertising, and public-place rules, and do not expose or supply tobacco to minors.

Notifications, humidor thresholds, and weather are recordkeeping aids. They do not replace calibrated equipment, fire precautions, or safe storage, and do not guarantee product condition. Do not use the app while driving, operating equipment, or when attention is required.

11. Service, changes, and intellectual property

CigarMind's name, marks, interface, code, and documentation are protected by intellectual-property law; your content is excluded. Do not imply an unauthorized relationship with us, Apple, or any cigar brand.

We may change or discontinue features for security, compliance, compatibility, or product improvement, with reasonable notice of material changes where practical. We do not promise uninterrupted, error-free service or compatibility with every device and OS version.

12. Disclaimers and liability

To the fullest extent permitted by law, the service is provided “as is” and “as available,” without additional warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. Back up and verify important records.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from AI errors, third-party services, data loss, device failure, tobacco use, or reliance on suggestions. Nothing here excludes non-waivable consumer rights or liability for personal injury, fraud, willful misconduct, or gross negligence where law forbids exclusion.

13. Suspension and termination

You may stop using the service, sign out, and delete your account at any time. We may restrict connected services if you materially breach these Terms, endanger security, infringe rights, or law requires action. We will give notice where reasonably practical and compatible with safety and law enforcement. Provisions that by nature should survive will remain effective.

14. Governing law, updates, and contact

These Terms are governed by the laws of the People's Republic of China without displacing mandatory consumer protections where you live. The parties should first try good-faith discussion; unresolved disputes may be taken to a court or consumer body with lawful jurisdiction.

We may update these Terms and will state a new effective date. Material changes will be signposted through the app or site where reasonable. Continued use after they take effect indicates acceptance unless law requires separate consent.
